Terms and Conditions
1. Definition: "Holly and Ivy" means Holly and Ivy Christmas Services ABN 69 496 885 455, their sub-contractors, agents and authorised employees. 'The Customer" means the person, company or agent of The Customer who appears under the 'Bill To' on the tax invoice, hiring the tree from Holly and Ivy.
2. Ownership: All Christmas Trees and Decorations remain the property of Holly and Ivy.
3. Care of Hired Trees: The Customer is responsible for looking after the Christmas Tree/Decorations while under his or her care but will not be liable for minor wear and tear. A small amount of accidental breakage is understood and overlooked. Please collect and retain broken decorations for return to Holly and Ivy when we collect your tree. However, missing items or significant breakage will be treated as stolen, lost or vandalised. The Customer will be required to pay the full replacement value of such items.
4. Care of Electrical Decorations: Electric Fairy-Lights, when supplied, are high-quality sealed units. The client must treat these items with the care required of all electrical equipment. Make sure that the electrical plug is dry before putting it into any socket.
5. Cancellation: If The Customer cancels the Agreement prior to the commencement of the stated delivery date, then Holly and Ivy reserves the right to charge the following as a percentage of the figure appearing on the tax invoice and as stated: 8-30 days notice, no charge; 3-7 days notice, 50% of the hire total; 1-2 days notice, 75% of the hire total; and on the day of delivery/collection 100% of the invoice total.
6. Alterations: If the Customer reduces the quantity of Hire items within 7 days of the delivery date, Holly and Ivy reserves the right to charge for the reduction at the percentages stated in 'Cancellation' (relevant to the total hire).
7. Liability: Holly and Ivy will not be held responsible for any accidents or injury in relation to the hire.
